Продавец обязуется передать в собственность Покупателю животное, именуемое впоследствии Собака, а Покупатель принять и выплатить ее стоимость: / The Seller undertakes to transfer an animal (hereinafter called “the Dog”) to the Buyer and the Buyer shall accept and pay the Seller its cost:

Ни одна вакцина не даёт 100% защиты от инфекции. Покупатель обязан помнить об этом и избегать выгула и контакта с собаками без сопровождения хозяина, больными и недавно переболевшими животными до полной вакцинации своей собаки.

No vaccine provides 100% protection against infection. The Buyer must be aware of this and avoid walking and contact the Dog with the sick dogs being unaccompanied by the owner or recently ill animals, until their dog’s vaccination is completed.

1.16. Претензий к экстерьеру и физическому состоянию Собаки Покупатель не имеет / The Buyer does not have any claims to the exterior and physical condition of the Dog.

2. Условия договора / Contract conditions.

2.1. Гарантии, права и обязанности Продавца / Guarantees, rights and obligations of the seller:

2.1.1. Продавец подтверждает состояние здоровья и чистопородность передаваемой Собаки, ее соответствие характеристикам, указанным в настоящем Договоре, только на момент продажи, но не дает гарантий на будущее относительно непременного достижения высоких результатов в выставочной карьере и репродуктивных качеств. Передача Собаки со скрытыми генетическими недостатками, которые невозможно определить на момент актирования, не подлежит ответственности ни со стороны Продавца, ни со стороны клуба.

The seller confirms to the Buyer the state of health and a thoroughbred animal of the transferred Dog, her features formulated in this Contract only during sale, but does not guarantee for the future regarding necessarily high results in the exhibition career and reproductive qualities. The transmission of Dogs with hidden genetic defects which can not be determined at the time of the inspection shall not be liable either by the Seller or by the club.

2.1.2. Продавец гарантирует Покупателю посильную поддержку в части консультаций по уходу за Собакой, ведения племенной работы, участия в выставках.

The Seller warrants the Buyer all possible support in terms of advice on the dog care, conducting breeding work, participation in exhibitions.

2.1.3. Продавец обязуется передать Покупателю документ о происхождении Собаки (родословную) не позднее достижения ее возраста 9-ти месяцев. При передаче Собаки Покупателю Продавец обязан предоставить ее щенячью карточку.

The Seller is obliged to provide the Buyer with a document about the origins of the Dog (pedigree) by reaching age 9 months. When the Dog is transferred to the Buyer, the Seller is obliged to give the Buyer the Dog’s puppy card.

2.1.3. Продавец не несет ответственности за те недостатки, которые могут обнаружиться у Собаки во время роста, развития и не определяются на момент актирования.

The Seller is not responsible for the shortcomings that may appear in the Dog during its growth (development ) and are not determined at the time of inspection.

2.1.4. Продавец не несет ответственности за все физические дефекты, связанные с содержанием и воспитанием Собаки, возникшие в период пребывания у Покупателя.

The Seller is not responsible for any physical defects associated with the maintenance and education of the Dog, appeared during their stay at the Buyer.

2.1.5. Продавец имеет право размещать рекламную и иную информацию о данной Собаке на сайте питомника, других сайтах, включая сделанные Покупателем фото и видео.

The Seller has the right to place advertisement and other information on the Dog at the kennel, other sites, including made by the Buyer photos and videos.

2.2 Гарантии, права и обязанности Покупателя: / Guarantees of rights and obligations of the Buyer:

2.2.1. ПОКУПАТЕЛЬ понимает все риски, связанные с развитием и ростом Собаки как живого организма. ПОКУПАТЕЛЬ понимает невозможность гарантии ПРОДАВЦОМ на некоторые качества СОБАКИ, указанные в этом Договоре на момент его подписания, которые могут измениться в процессе взросления СОБАКИ и повлиять на ее перспективность в разведении и участия в выставках. / The Buyer understands all risks connected with development and growth of the Dog as a live organism. The Buyer understands impossibility of a guarantee the Seller on some qualities of the Dog specified in this Contract for the moment of its signing which can change in the course of growing of the Dog and affect her prospects in cultivation and participation in exhibitions.

2.2.2. Если ПОКУПАТЕЛЬ по какой-либо причине больше не в состоянии держать у себя Собаку, то он обязан поставить об этом в известность Продавца, согласовать с ним дальнейшую судьбу Собаки и позаботиться о том, чтобы новый владелец взял на себя обязательства ПОКУПАТЕЛЯ по настоящему Договору.

If the Buyer for any reason is not any longer in a condition of holding the Dog, it is obliged that he will notify about it the Seller, to coordinate with him the further destiny of the Dog and to take care that the new owner has incured obligations of the Buyer under the present Contract.

2.2.3. ПОКУПАТЕЛЬ вправе пригласить ветеринарного врача и кинолога, которые, участвуя в выборе Собаки, смогут выявить недостатки или незамеченные ранее заболевания, определяемые при осмотре.

The Buyer has the right to invite a veterinary and the cynologist which, participating in the choice of a dog, can reveal defects or before not noticed disease, defined at the inspection.

2.2.4. ПОКУПАТЕЛЬ обязуется обеспечить Собаке надлежащее содержание, своевременные ветеринарное обслуживание и вакцинацию.

The Buyer undertakes to provide the Dog appropriate care and maintenance, duly veterinary service and annual vaccination.

2.2.5. ПОКУПАТЕЛЮ предоставляется право и возможность обследовать здоровье Собаки на наличие врожденных аномалий внутренних органов в ветклинике, имеющей государственную лицензию, в течение 5 календарных дней после заключения настоящего Договора (день заключения не включается). Если у щенка на момент продажи не закончен карантин после комплексной вакцинации, началом проверки здоровья можно считать 10-й день после второй комплексной вакцинации (день вакцинации не включается).

The Buyer is given the right and possibility to survey the health of the Dog on availability of congenital anomalies of internal bodies in a veterinary clinic having the state license, within 5 calendar days after the conclusion of the present Contract (day of the conclusion does not included). If at the moment of sale the puppy has not finished quarantine after a complex vaccination, the beginning of the health inspection may count the 10 day following the complex vaccination (the day of the vaccination is not included).

2.2.6. ПОКУПАТЕЛЬ обязуется не заниматься «нелегальной» племенной деятельностью и не поддерживать таковую, а проводить племенную работу в соответствии с Положениями, принятыми кинологической организацией той страны, где зарегистрирована Собака.

Для участия в племенной деятельности Покупатель обязан получить допуск к разведению Собаки на выставке и руководствоваться Положением о племенной работе. Решение о возможной вязке Собаки принимает Покупатель.

The Buyer agrees not to engage in 'illegal' activities of breeding and not to support such, but to carry out breeding work in accordance with the Regulations adopted by the canine organization of the country where the Dog is registered. For participation in a breeding activity the Buyer is obliged to receive admission to breeding of the Dog at an exhibition and to be guided by Regulations of the breeding work. The decision on the possible mating of the Dog takes the Buyer.

2.2.7. Покупатель обязуется вернуть Собаку Продавцу по первому требованию, безоговорочно, со всеми регистрационными документами, без возмещения своих затрат, в случаях:

The Buyer is obliged to return the Dog to the Seller on demand, unreservedly, with all registration documents, without reimbursement of their costs, in the following cases:

- неудовлетворительное питание, уход, ветеринарное обслуживание;

poor nutrition, grooming, veterinary care;

- допущения в отношении Собаки действий (или бездействия), ставящее под угрозу ее жизнь и здоровье;

admitions in concern of the Dog actions (or inactivity), which endangers its life and health;

- недопустимое обращение с Собакой, признаваемое в соответствии с действующим законодательством Республики Беларусь или страны, в которой зарегистрирована Собака, или нормами международного права «жестоким обращением с животными»;

The inadmissible treatment of the Dog, which according to the current legislation of the Republic of Belarus or the country in which the Dog is registered, or norms of international law is recognized as being « cruel treatment with animals »;

3. Условия возмещения ущерба / Terms of redress.

3.1. Причиной для возмещения ущерба могут служить только: / The reason for compensation of damage can serve only:

- врожденные аномалии внутренних органов, не совместимые с жизнью;

The congenital anomalies of internal organs not compatible with life;

- заболевание чумой, энтеритом, гепатитом (в течение первых 7 дней действия настоящего Договора, включая день заключения);

The plague disease, enteritis, hepatitis (within the first 7 days of this Contract, including the day of the signing);

3.2. Покупатель при предъявлении претензий по возмещению ущерба обязуется предоставить Продавцу: / The Buyer upon the presentation of the claims for damages is obliged to provide the Seller:

А/A) заключение квалифицированного ветеринарного врача клиники, имеющей государственную лицензию, подтверждающее, что Собака на момент продажи была больна, а также результаты обследований, анализов, проводимого лечения (идентификация Собаки обязательна);

The conclusion of the qualified veterinary of a clinic having the state license, confirming, that the Dog at the moment of the sale was sick, as well as results of inspections, analyses, spent treatment (identification of the Dog is mandatory);

Б/B) заключение с подписями и печатями как минимум двух квалифицированных ветеринарных врачей клиники, имеющей государственную лицензию, о результатах вскрытия трупа Собаки (в случае гибели), подтверждающее, что причиной смерти явились заболевания, перечисленные в п.3.1. (идентификация Собаки обязательна);

The conclusion with signatures and seals at least of two qualified veterinaries of a clinic having the state license, about the results of autopsy of the Dog (in case of death), confirming, that the reason of death was the diseases listed in п.3.1. (identification of the Dog is mandatory);

В/C) заключение квалифицированного ветеринарного врача клиники, имеющей государственную лицензию, о состоянии здоровья Собаки, полученное в течение 5 календарных дней после заключения настоящего Договора (п.2.2.5.).

The conclusion of the qualified veterinary of a clinic having the state license, about health of the Dog, received within 5 calendar days after the conclusion of the present Contract (2.2.5.).

3.3. Если Покупатель не выполнил условия, изложенные в п.3.2, дальнейшие претензии Продавцом не принимаются, возмещение ущерба не производится.

If the Buyer has not satisfied the conditions stated in item 3.2 the further claims of the Seller is not accepted, compensation of damage is not made.

3.4. Возмещение ущерба по п.3.1. Покупателю производится в виде выплаты полной суммы стоимости Собаки или предоставлению другой равноценной Собаки по договоренности. По требованию Продавца Собака, явившаяся причиной возмещения ущерба, должна быть возвращена Продавцу. Ущерб должен быть возмещен не позднее 12 месяцев с момента предоставления Продавцу документов, подтверждающих его необходимость. Расходы, связанные с содержанием Собаки у Покупателя, не возмещаются. Возможны другие варианты возмещения ущерба по согласованию Сторон.

Compensation of damage in accordance with 3.1. to the Buyer is made in the form of payment of the full sum of the cost of the Dog or to provision of other equivalent dog under the arrangement. On demand of the Seller the Dog who was the reason for compensation of damage, should be returned to the Seller. The damage should be compensated not later than 12 months from the moment of provision the Seller with the documents confirming its necessity. The expenses associated with maintenance of the Dog being at the Buyer, are not compensated. There may be other options for redress by agreement of the parties.

3.5. В исключительном случае при возврате Собаки, не связанном с ее качеством, по соглашению обеих Сторон Продавец может принять Собаку назад / The seller can accept the Dog back only by agreement of the parties as an exceptional case, not connected with quality of the Dog, with a condition:

- до 3 дней со дня покупки Продавец удерживает 25 % от стоимости собаки как компенсацию за моральный ущерб и карантин;

up to 3 days from the date of purchase, The seller holds from the cost of a dog 25 % for compensation of moral damage and a quarantine;

- до 5 дней со дня покупки Продавец удерживает 50 % от стоимости собаки как компенсацию за моральный ущерб и карантин;

up to 5 days from the date of purchase, The seller holds from the cost of a dog 50 % for compensation of moral damage and a quarantine;

- до 15 дней со дня покупки Продавец удерживает 75 % от стоимости собаки как компенсацию за моральный ущерб и карантин.

up to 15 days from the date of purchase, The seller holds from the cost of a dog 75 % for compensation of moral damage and a quarantine;

День заключения настоящего Договора включается. При возврате в более поздние сроки компенсация стоимости Собаки не производится.

The day of the signing of the present Contract is included. Upon return at later timeframes the compensation of the cost of the Dog is not made.

4. Особые условия передачи Собаки / Special conditions of transfer of the Dog

5. Прочие условия / Other conditions

5.1. Стоимость Собаки составляет / The cost of the Dog is____________________________________________________________________,

включая аванс в размере / Including advance payment at a rate of ____________________________________________________________.

5.2. В стоимость Собаки включены сама Собака, родословная БКО-FCI, ветеринарный паспорт, дегельминтизация и вакцинация комплексными вакцинами по возрасту, клеймение. Экспортная родословная, чипирование, дополнительные вакцинации, прочие расходы, связанные с приобретением животного, оплачиваются Покупателем дополнительно.

The cost of the Dog includes the Dog itself, the pedigree BCU-FCI, a veterinary passport, dehelmintization and vaccination with complex vaccines by age, branding. Export pedigree, chipping, additional vaccination, other costs related to the purchasing of the animal, shall be paid by the Buyer additionally.

5.3. Договор составлен в двух экземплярах, имеющих одинаковую юридическую силу, по одному экземпляру для каждой из Сторон, вступает в силу с момента его подписания и действует на протяжении всей жизни Собаки. Ответственность Сторон установлена настоящим Договором и действующим законодательством Республики Беларусь. Нотариальное заверение настоящего Договора не требуется.

The contract is made in duplicate, having an identical validity, for one copy for each of the Sides, comes into force from the moment of its signing and acts for the entire life of the Dog. The responsibility of the Sides is established by the present Contract and the current legislation of the Republic of Belarus. The notarial assurance of the present Contract is not required.

5.4. Все изменения и дополнения настоящему Договору являются его неотъемлемой частью и действительны, если они совершены в письменной форме и подписаны каждой из Сторон.

All variations and additions to the present Contract are its integral part and are valid, if they are accomplished in writing and signed by each of the Sides.

5.5. Настоящий Договор может быть расторгнут в одностороннем порядке в случае неисполнения одной из Сторон его условий.

The present Contract maybe terminated unilaterally in case of failure of one of the Sides of its conditions.

5.6. Сторона, имеющая намерение расторгнуть настоящий Договор в одностороннем порядке, обязана, в срок не позднее тридцати дней до предполагаемой даты расторжения Договора, направить другой Стороне соответствующее письменное уведомление с подробным обоснованием причин расторжения.

The side having intention to terminate the present Contract unilaterally, is obliged, in time not later than thirty days before prospective date of cancellation of the Contract, to direct to the other Side the appropriating notice in writing with a detailed background of the reasons for cancellation.

5.7. Сторона, получившая уведомление о намерении другой Стороны расторгнуть Договор, обязана в срок не позднее пятнадцати дней с даты получения такого уведомления либо представить свои письменные возражения против расторжения Договора, либо ответить письменным согласием. Молчание Стороны, получившей уведомление о расторжении Договора, расценивается как согласие на расторжение Договора.

The side which has received the notice of the intention of the other Side to terminate the Contract, is obliged in time not later than fifteen days from the date of receiving of such notice or to present the written objections against cancellation of the Contract, or to answer with an approval in writing. The silence of the Side which has received the notice on cancellation of the Contract, is regarded as an agreement to cancellation of the Contract.

5.8. Все уведомления и предупреждения по настоящему Договору будут считаться исполненными надлежащим образом при условии направления их заказным письмом, телеграммой или вручением другой Стороне под расписку по адресам, указанным в настоящем Договоре.

All notices and warnings under the present Contract will be considered properly executed providing that they are sent as a registered letter, the telegram or delivery to the other Side against receipt to the addresses specified in the present Contract.
5.9. В случае достижения соглашения о расторжении Договора, Стороны определяют порядок взаимоотношений по расторжению Договора.

In case of achievement of the agreement on cancellation of the Contract, the Sides define the order of relationships on cancellation of the Contract.
5.10. Все споры и разногласия должны разрешаться путем переговоров между Сторонами. В случае невозможности разрешения споров путем переговоров Стороны решают их в судебном порядке. В том, что не предусмотрено настоящим Договором, Стороны руководствуются действующим законодательством.

All disputes and disagreements must be resolved by negotiations between the Sides. In case of impossibility of the resolution of disputes by negotiations the Side solve them in the judicial order. In that what is not provided by the present Contract, the Sides are guided by the current legislation.
